HIPAA NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Which Teladoc Health entities are covered by this Notice?

This Notice applies to Teladoc Health, Inc. and certain related entities that work together to provide healthcare services. Teladoc Health, Inc. and its affiliated companies — including, but not limited to, Livongo Health, Inc., Catapult Health, LLC, Best Doctors, Inc., HealthiestYou, Inc., myStrength, Inc., and Advance Medical, Inc. — operate together as a single Affiliated Covered Entity (ACE) under the Health Insurance Portability and Accountability Act (HIPAA). As an ACE, these entities may use and share protected health information (PHI) with each other for treatment, payment, and healthcare operations.

This Notice also applies to Teladoc Health Medical Group, P.A. and its affiliated professional entities. These medical groups are independent provider organizations, but they participate with Teladoc Health in a HIPAA-defined Organized Health Care Arrangement (OHCA). The OHCA allows Teladoc Health and these medical groups to integrate care, improve quality, and carry out certain joint healthcare operations. PHI may be shared among OHCA participants as permitted by HIPAA to support your care and related operations.

When this Notice refers to “Teladoc Health,” “Teladoc,” “we,” “us,” or “our,” it means Teladoc Health, Inc., the affiliated ACE participants covered by this Notice, and the medical groups that participate in the OHCA described above. Catapult Health, LLC is part of the ACE but maintains a separate, aligned Catapult Health Notice of Privacy Practices.

Can this Notice change?

Yes. We may update this Notice from time to time. Any changes will apply to all PHI we maintain as a HIPAA Covered Entity, and the updated Notice will be available on our website.

What is protected health information (PHI)?

PHI is information, held by a Covered Entity, that identifies you and relates to:

  • Your past, present, or future physical or mental health or condition
  • Healthcare services provided to you, and/or
  • Payment for your healthcare services

How does Teladoc Health use and share your information?

We use and share your PHI only as allowed by law, including for the following purposes:

Treatment

We use and share your PHI to provide medical care and services to you. For example, this may include sharing information with healthcare providers involved in your care and making prior visit information available to support continuity of care.

Payment

We use and share your PHI to support billing and collecting payment for services, including working with health plans and other payers. For example, this may include sending a claim to your health plan for payment.

Healthcare operations

We use and share your PHI to run our organization and support healthcare delivery. For example, this includes:

  • Improving services and quality of care
  • Providing customer support
  • Monitoring provider qualifications
  • Creating de-identified and/or aggregate information.
  • Coordinating care and supporting continuity of care, including coordinating information across Teladoc Health services and affiliated digital health services that provide complementary care; helping guide you between services or manage transitions when you choose to use multiple services (such as through single sign-on (SSO)); and participating in secure clinical data networks and health information exchanges, as permitted by law.

Participation in Health Information Exchanges

To support treatment, care coordination, and healthcare operations, Teladoc Health participates in secure electronic health information exchanges (HIEs) and clinical data networks as permitted by law. Depending on applicable state law and exchange policies, you may be able to opt out of participation in certain exchanges. You may submit an opt-out request, here. Exchange connectivity is supported by Zus Health, a third-party interoperability provider. Use of Automated Tools

As part of our healthcare operations and HIPAA-permitted purposes, Teladoc Health may use Automated Tools, including AI-enabled technology, to support quality improvement, care coordination, clinical documentation, operational efficiency, and service navigation related to the delivery of healthcare services. These tools are designed to assist our workforce and providers and do not make clinical decisions or replace the independent judgment of licensed healthcare professionals. We may disclose your PHI to service providers that support our technology; any such disclosure will comply with HIPAA.

Uses and Disclosures Requiring Your Authorization

Certain uses and disclosures of your protected health information (PHI) are permitted only with your written authorization. These include:

Marketing

We will not use or disclose your PHI for marketing purposes that require authorization under HIPAA without your written authorization. Certain communications about treatment alternatives, health-related products or services, or care coordination activities may be permitted by law without authorization.

Sale of Protected Health Information

We will not sell your PHI without your written authorization. A sale of PHI means a disclosure of PHI where we receive payment directly or indirectly in exchange for the information, as defined by HIPAA.

Revoking an Authorization 

If you provide an authorization, you may revoke it at any time by submitting a written revocation. A revocation will not apply to uses or disclosures already made in reliance on your authorization.

Substance Use Disorder treatment information

To the extent we receive or maintain information about you from a substance use disorder treatment program that is subject to additional federal protections under 42 CFR Part 2 (“Part 2 Program”), we will use and disclose it in accordance with applicable federal law. We are not a Part 2 Program. 

  • If we receive Part 2 protected information through a general consent you provide to a Part 2 Program for treatment, payment, or health care operations, we may use and disclose that information for those purposes as described in this Notice.
  • If we receive Part 2 protected information through a specific consent you provide to us or another third party, we will use and disclose that information only as permitted by that consent.

In no event will we use or disclose Part 2 protected information, or testimony describing such information, in any civil, criminal, administrative, or legislative proceeding against you without your written consent or a court order that meets applicable legal requirements.

When are we required to share your information?

We may be required or allowed by law to share your PHI in certain situations, including:

  • Disclosures to the Secretary of U.S. Department of Health and Human Services for compliance and enforcement purposes
  • Public health and safety activities
  • Reporting abuse or neglect
  • Responding to court orders or legal processes
  • Workers’ compensation matters
  • Preventing serious threats to health or safety
  • Law enforcement or government oversight activities
  • Health oversight activities
  • Limited instances with coroners, medical examiners, and funeral directors
  • Organ donation and approved research
  • Institutional Review Board (IRB)-approved research
  • Specialized government functions, such as national security

What rights do you have regarding your information?

You have important rights regarding your protected health information (PHI). Your medical power of attorney or legal guardian can exercise these rights on your behalf as well. These rights are provided under federal law and, in some cases, may be subject to limitations or conditions.

How can you access your medical information?

The easiest and fastest way to access your medical information is through the Teladoc Health mobile app or by signing into your account on our website. Because Teladoc Health offers different types of services, the steps to access your records may differ slightly depending on the service(s) you used.

If you are unable to locate your records using the steps above, you may submit a written access request using the privacy rights portal (this will take longer and may include additional steps). The privacy rights portal is used for formal written privacy rights requests when you are unable to download your medical information through your member portal.

How do I exercise my other privacy rights?

For rights other than access — including requesting corrections/amendments, requesting restrictions, requesting confidential communications, or requesting an accounting of disclosures — please submit your request using our privacy rights portal. Note, Teladoc Health is not required to agree to a requested restriction, except where you request that we not disclose your PHI to a health plan for payment purposes and you (or another individual on your behalf) have paid in full. Certain requests may be denied or limited, as permitted by law. If your request is denied, you may submit a written appeal using the same process described above.
You may request a paper copy of this Notice or file a privacy complaint by contacting us as instructed below. Privacy complaints (a concern regarding Teladoc Health’s compliance with applicable privacy requirements) should be submitted in writing (via the email listed below) so that they can be properly reviewed and documented. Teladoc Health will not retaliate against any individual who files a privacy complaint

To exercise your privacy rights, you must submit your request in writing through our Privacy Rights Portal or by mail, as described above. For security and identity verification purposes, requests are not processed verbally. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint or exercising your privacy rights.
