Summary
This Policy applies to some health-related data that may be covered by state privacy laws.
It does not apply to Protected Health Information, or PHI, under HIPAA. PHI is covered by Teladoc Health’s HIPAA Notice of Privacy Practices.
Consumer health data may include some information from your use of our public websites.
This may include pages you view about wellness or telehealth services.
It may also include online activity that shows interest in health topics.
It may include health-related information you give us outside of a HIPAA-covered setting.
We may collect this data from you, from your online activity, and from partners that help us run or improve our websites.
We may use this data to help our websites work, keep them secure, remember your settings, improve our websites, and measure our messages.
If you consent, we may also use or share some data for ads and to measure how well ads work.
We may share data with service providers that help us run our websites and apps.
If certain state health privacy laws apply to you, you may have rights for this data.
These may include rights to access or delete this data. You may also have the right to withdraw consent for some uses.

This Consumer Health Data Privacy Policy supplements our General Privacy Policy and applies to personal information defined as “consumer health data” under applicable law, including Washington’s My Health My Data Act (MHMDA) and the Nevada Health Data Privacy Act (NHDPA). Capitalized terms not defined in this policy have the meanings set forth in the General Privacy Policy. To be clear, this CHD Privacy Policy does not apply to any data considered Protected Health Information (PHI) as defined by HIPAA. Consumer Health Data We Collect
Section 1 and Section 2 of the General Privacy Policy details the data we collect. Consumer Health Data (CHD) is defined broadly, so some of the categories of data we collect may also be considered CHD and may fall under the following categories of CHD:
- Information about the Website content viewed- including the viewing of pages related to wellness or telehealth services, but do not reveal or relate to a visitors’ health status or provision of healthcare.
- Information derived or inferred from online activity - that suggests an interest in health topics (for example, engaging with web features related to specific health topics).
- Communications that include health-related information provided outside of a HIPAA-covered context.
We do not treat information collected through our Secure Platforms or in a HIPAA-covered context as Consumer Health Data; that information is PHI and is governed by HIPAA. For information regarding PHI, see our HIPAA Notice of Privacy Practices.
Sources of Consumer Health Data
Section 1 and Section 2 of the General Privacy Policy details the data we collect. Consumer Health Data (CHD) is defined broadly, so some of the categories of data we collect may also be considered CHD. CHD may be collected from the following sources:
- Directly from you
- Indirectly from you, as detailed in Section 2 of the General Privacy Policy.
- From our partners, for example, we may receive certain Visitor Data from our analytics service providers.
Purpose and Use of Your Consumer Health Data
We may use your CHD in the following ways:
- Ensure our Websites function properly and securely
- Remember your preferences and settings
- Understand how you use our Websites to make improvements
- Measure the effectiveness of our communications
- Provide relevant advertising and measure advertising effectiveness, where you have consented
Sharing Consumer Health Data
We share data with our service providers to operate the Websites and to perform necessary website and application functions. Additionally, provided you opt-in/consent, we may share some data with third parties for advertising purposes. See Section 1 and Section 2 of the General Privacy Policy for more information.
Consumer Health Data Privacy Rights
If you are covered by the MHMDA, the NHDPA, or other applicable consumer health privacy law, then you may have certain rights regarding CHD, including right to access, request, erasure, or withdraw consent relating to such data, subject to certain exceptions.
